1. ACCEPTANCE OF TERMS

By accessing or using SadiBandhan.com ("Platform," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use this Platform.

For Users Under 18: This Platform is strictly for users aged 21 years or above for males and 18 years or above for females. If you do not meet the above criteria, you are prohibited from using this service.

2. DEFINITIONS

Profile
Information submitted by a User including personal details, photographs, preferences, and biodata.
Match
A suggested compatible profile based on User preferences and Platform algorithms.
Contact Information
Phone number, email address, WhatsApp, or other communication details.
Success
When User(s) enters into engagement or marriage.
Subscription
Paid membership granting enhanced access to Platform features.
Verification
Process of confirming authenticity of User information through document checks, video calls, or third-party validation.

3. ELIGIBILITY AND REGISTRATION

3.1 Eligibility Criteria

You represent and warrant that:

  • You are legally eligible to marry under Indian law
  • You are not currently married (unless explicitly using services for remarriage and have disclosed your marital status)
  • You are registering with genuine matrimonial intent
  • All information provided is accurate, current, and complete

3.2 Account Registration

  • You must provide accurate information including name, date of birth, contact details, and identity documents
  • You are responsible for maintaining the confidentiality of your login credentials
  • You agree to notify us immediately of any unauthorized access to your account
  • One person may maintain only ONE active profile. Multiple accounts by the same person will be terminated without refund

3.3 Account Verification

  • We reserve the right to verify your identity through Aadhaar, PAN, government-issued ID, video verification, or other means
  • Unverified accounts may have limited functionality
  • We may reject or suspend accounts that fail verification or provide false information
  • Users may decline verification but profile will be marked "Unverified"
  • Unverified profiles will have severely restricted access to Platform features

4. USER CONDUCT AND PROHIBITED ACTIVITIES

4.1 Acceptable Use

This website is strictly for matrimonial purpose only and not a dating website. You agree to use the Platform solely for legitimate matrimonial purposes.

4.2 Prohibited Activities

You shall NOT:

Misrepresentation:

  • Provide false, inaccurate, or misleading information
  • Use someone else's photographs or identity
  • Misrepresent your marital status, employment, income, education, or family background
  • Create fake or fraudulent profiles

Harassment and Abuse:

  • Harass, abuse, threaten, or intimidate other Users
  • Send unsolicited sexual, obscene, or offensive content
  • Stalk or persistently contact Users who have declined interest
  • Engage in hate speech based on religion, caste, gender, or region

Commercial Exploitation:

  • Use the Platform for commercial solicitation or advertising
  • Operate as a marriage bureau or broker without authorization
  • Recruit Users for other services or platforms
  • Scrape, copy, or harvest User data

System Abuse:

  • Use automated systems, bots, or scrapers to access the Platform
  • Attempt to hack, reverse-engineer, or compromise Platform security
  • Upload viruses, malware, or malicious code
  • Bypass payment systems

Legal Violations:

  • Engage in dowry demands or discussions (prohibited under Dowry Prohibition Act, 1961)
  • Facilitate child marriage (prohibited under Prohibition of Child Marriage Act, 2006)
  • Violate any applicable Indian laws or regulations

4.3 Consequences of Violation

Violations may result in:

  • Immediate account suspension or termination without refund
  • Forfeiture of all paid subscriptions
  • Legal action and cooperation with law enforcement
  • Permanent ban from Platform services

5. PAYMENT TERMS AND OFFERS

5.1 Payment Terms

  • All fees are in Indian Rupees (INR)
  • Payments accepted via UPI, credit/debit cards, net banking, and wallets
  • Payments on this Website are processed through Razorpay Payment Gateway integration
  • We do not store your payment card or banking information. All payment data is securely handled by Razorpay
  • By submitting your payment information, you grant us permission to share it with Razorpay for processing
  • We may adjust prices for new subscriptions or renewals with reasonable notice where required by law
  • Subscriptions are non-refundable unless explicitly stated
  • Price changes will be communicated 30 days in advance for existing subscriptions
  • All prices are inclusive of applicable taxes

5.2 Promotional Offers

  • Promotional pricing and discounts are time-limited
  • We reserve the right to modify or cancel promotions at any time
  • Refund policies apply to promotional subscriptions as well

6. SUCCESS FEE AND DEPOSIT STRUCTURE

6.1 Success Fee Definition

A "Success Fee" is payable when a User finds a match through the Platform that results in engagement or marriage, as verified through our Success Verification Process. Success Fee is separate from core subscription plans.

6.2 Premium Plan Success Fee

  • Success Fee will be decided by us and intimated to you beforehand
  • Success fee is payable within 20 days of engagement announcement
  • The Success Fee is only refundable in case of verified cancellation of marriage by both the parties

6.3 Success Verification Process

To trigger success fee payment, both parties must:

  1. Independently confirm relationship status through Platform or to its representative(s)
  2. Upload engagement photographs (ring exchange, family gathering)
  3. Provide engagement date and expected wedding date
  4. Complete relationship journey questionnaire

Important Clarification: The Success Fee is a contractual obligation tied to premium benefits and community recognition, not a legally enforceable penalty. It is an encouraged contribution to support Platform sustainability and non-payment does not result in legal action.

6.4 REFUND AND CANCELLATION POLICY

  • Refunds not applicable once payment is processed
  • Exception: Technical issues preventing Platform access (reviewed case-by-case within 7 days)
  • No refunds for Terms violations or account termination

6.5 CHARGEBACK POLICY

  • Unauthorized chargebacks may result in account suspension
  • Disputes must be raised with us before initiating chargeback

7. CONTENT AND INTELLECTUAL PROPERTY

7.1 User Content Ownership

You retain ownership of content you upload (photos, profile text, messages). By uploading content, you grant us:

  • Non-exclusive, worldwide, royalty-free license to display your content on the Platform
  • Right to use your content for Platform promotion (only with explicit consent)
  • Right to moderate, remove, or edit content that violates these Terms

7.2 Prohibited Content

Do not upload:

  • Copyrighted material you don't own
  • Explicit, sexual, or obscene images
  • Photoshopped or heavily filtered images that misrepresent appearance
  • Images of minors or non-consenting third parties
  • Content promoting violence, discrimination, or illegal activities

7.3 Platform Intellectual Property

All Platform elements are owned by us:

  • Website design, layout, algorithms, code
  • Logo, branding, trademarks
  • Original content created by Platform

You may not:

  • Copy, reproduce, or distribute Platform content
  • Reverse-engineer Platform technology
  • Use our branding without written permission

8. SAFETY GUIDELINES AND RECOMMENDATIONS

8.1 Meeting Safety

When meeting matches in person:

  • Meet in public places during daytime
  • Inform family/friends of meeting location and time
  • Arrange your own transportation
  • Do not share financial information early
  • Trust your instincts; leave if uncomfortable
  • Verify identity before sharing personal details

8.2 Financial Safety

  • NEVER send money to Users you haven't met in person
  • Be wary of requests for loans, investments, or financial help
  • Do not share bank details, PAN, or Aadhaar with other Users
  • Dowry demands are illegal and should be reported immediately

8.3 Information Safety

  • Do not share home address until thoroughly comfortable
  • Be cautious about sharing workplace details
  • Use Platform messaging before moving to personal phone/WhatsApp
  • Do not share intimate photographs

8.4 Reporting Mechanism

We investigate all reports within 48 hours and take appropriate action.

9. TERMINATION

9.1 Termination by User

  • You may delete your account anytime via Account Settings
  • Deletion is permanent and cannot be undone

9.2 Termination by Platform

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent activity
  • You harass other Users
  • You remain inactive for 24 months and do not communicate with us
  • Required by law or legal authority

9.3 Effect of Termination

Upon termination:

  • Your profile becomes invisible immediately
  • You lose access to all messages and connections
  • Paid subscriptions are forfeited (unless eligible for refund)
  • Success fee obligations (if applicable) remain in effect
  • We may retain data as required by law. Such retention is limited to compliance, dispute resolution, fraud prevention, and legal obligations

10. MODIFICATIONS TO TERMS

10.1 Right to Modify

We reserve the right to modify these Terms after 30 days of notification through email. Changes are effective immediately for all users. Users are requested to check the Terms & Conditions, Privacy Policy and Disclaimer pages from time to time.

10.2 Acceptance of Changes

Continued use after 30 days constitutes acceptance. If you disagree:

  • Discontinue Platform use
  • Request account deletion within 30 days through proper channel

11. DISPUTE RESOLUTION

11.1 Governing Law

These Terms are governed by the laws of India. Courts in West Bengal have exclusive jurisdiction.

11.2 Arbitration Agreement

Disputes shall be resolved through arbitration:

  • Single arbitrator appointed mutually
  • Arbitration conducted in Kolkata
  • Proceedings in English or Bengali
  • Arbitration costs split equally unless arbitrator decides otherwise
  • Arbitrator's decision is final and binding

This arbitration clause applies to disputes arising out of or in connection with these Terms, to the extent arbitrable under Indian law.

11.3 Exceptions to Arbitration

Following matters may be brought directly to court:

  • Intellectual property disputes
  • Injunctive relief for Terms violations
  • Small claims court matters (below ₹20,000)

11.4 Class Action Waiver

You agree to resolve disputes individually. No class actions, class arbitrations, or representative actions permitted.

12. MISCELLANEOUS

12.1 Entire Agreement

These Terms, Privacy Policy, and any referenced policies constitute the entire agreement.

12.2 Severability

If any provision is found invalid, remaining provisions continue in effect.

12.3 No Waiver

Our failure to enforce any right doesn't waive that right.

12.4 Assignment

You cannot transfer your account. We may assign our rights to affiliates or successors.

12.5 Force Majeure

We're not liable for delays/failures due to circumstances beyond our control (natural disasters, pandemics, wars, government actions, technical failures).

12.6 Language

These Terms are in English. In case of translation discrepancies, English version prevails.

12.7 Relationship

No partnership, agency, or employment relationship created between you and Platform.

12.8 Data Protection

The processing of your personal data shall comply with the Digital Personal Data Protection Act, 2023, and the rules notified thereunder, as detailed in our Privacy Policy.

12.9 Anti-Circumvention Clause

Users are strictly prohibited from sharing personal contact details (phone numbers, social media handles, or personal emails) within the 'About Me' or 'Bio' sections of their profile.

Any attempt to bypass the Platform's payment gateway to obtain contact information will result in immediate profile suspension without refund.

13. ACKNOWLEDGMENT

By using the Platform, you acknowledge:

  • You have read and understood these Terms
  • You are legally eligible to marry
  • You are 21 years or older if you are a male or 18 years or older if you are a female
  • Information you provide is accurate and truthful
  • You will use the Platform responsibly and legally
  • You understand refund and success fee policies
  • You accept all risks associated with meeting Users offline
